Does Your Website Clearly Define the Confidentiality of Complaints?
FSBPT formed the Boundary Violation Task Force in 2020. One of the task force’s goals is to identify potential barriers for reporting violations to regulatory boards. To help accomplish this, task force members reviewed jurisdictions’ websites. The task force members only reviewed websites they were unfamiliar with, and they tried to view them via the lens of someone who had experienced sexual misconduct during physical therapy and was contemplating filing a complaint with the board.
While reviewing the websites, task force members sought to find language to determine whether a complaint can be filed anonymously, confidentially, or if the complaint must be public record (and then selected all that applied). While the majority of the websites did provide specific language, there was still a large number of jurisdictional websites where the anonymity or confidentiality of a complaint was not clearly identified.
Because of the sensitive nature of sexual boundary violations, the task force feels that clarity regarding the anonymity or confidentiality of a complaint is important information to share with complainants. The task force encourages jurisdictions to review the language of their websites and make changes as necessary to decrease any unnecessary barrier to reporting a complaint.
Takeaway tip: Consider how your jurisdiction classifies reports made about boundary violations and if it is clear to the claimant that their report will be anonymous, confidential, or public record. Do you explain the need to follow up with contact to the claimant in order to fully investigate reports?

"States are increasingly relying on telehealth to provide behavioral health services to Medicaid enrollees. Before the COVID-19 pandemic, telehealth was an important tool for States to increase access to behavioral health services for enrollees in rural or underserved areas with provider shortages. During the COVID-19 pandemic, States expanded their use of telehealth to help meet the needs of enrollees while also reducing the risks from community spread of the virus. As the Nation confronts the psychological and emotional impact of COVID-19, the use of telehealth will be important in addressing behavioral health needs for Medicaid enrollees."
"In our opinion: Utah should increase opportunities for work through occupational licensing reforms," Desert News, February 25, 2019
"Utah has taken some steps in the right direction with regard to occupational licensing. For instance, educators and spouses of active military personnel receive leniency in Utah for outside licenses. And two years ago the state Legislature eased requirements for certain contractors and plumbing and electricity apprentices. Currently, the Legislature is considering competency-based occupational licensing, which opens up the possibility of receiving a license upon the demonstration of skills rather than through a traditional time-based path. But even more progress could be made."
